The Purpose of an Immigration Appeal
If your immigration application or petition was declined, you have the opportunity to appeal the decision. With help from one of our experienced immigration lawyers at Hermanni & Lorenzo Law Group, together we can prepare the appropriate paperwork and get your case started to hopefully reverse the decision.
Types of Immigration Appeals
An immigration court appeal is a distinct type of deportation defense where you ask a higher authority to review the lower office’s decision. To appeal your immigration case is like getting a second opportunity at convincing a judge that you should be allowed to stay in the United States.
There are two types of appeals that can be filed:
- Appeals to the Administrative Appeals Office (AAO) – oversees appeals for employment-based visas, investment-based visas, petitions for aliens to come into the United States temporarily for services, labor or religious work.
- Appeals and Motions to the Board of Immigration Appeals (BIA) – overseas appeals for deportation decisions, denials of I-130 and bond adjudication.
